We operate exclusively on the basis of the most recent version of the German Freight Forwarders' Standard Terms and Conditions (ADSp).
In Section 23 of these Terms and Conditions (ADSp) legal liability for damage to goods is limited to 8.33 SDR per kilogramme – in compliance with § 431 of German Commercial Law (HGB) – in cases of damage occurring to goods whilst being carried; in the case of a contract of multimodal carriage (including maritime transport) liability is limited to 2 SDRs per kilogramme and in the event of damage to €1.25 million or €2 million or 2 SDRs per kilogramme, depending on which amount is highest (SDR = Special Drawing Rights). Section 27 of the Terms and Conditions (ADSp) is not valid as an agreement on other maximum liability amounts as defined under the terms of Art. 25 of the Montreal Convention.
